Muhammad Salah V. The State,

YLR 2018 Note 284 · Balochistan High Court

Muhammad Salah was convicted by a trial court for murder and sentenced to life imprisonment after being accused, along with several co-accused, of shooting the complainant's brother Sachal during an alleged ambush on a road in 2012. The prosecution said the killing was motivated by an earlier declaration that the victim's family had committed "Siahkar" (a tribal honor-related accusation). Salah appealed his conviction, while the complainant separately sought a harsher sentence.

The Balochistan High Court overturned the conviction and acquitted the accused. Reviewing the evidence, the judges found the two eyewitnesses, including the complainant himself, gave contradictory accounts on key details such as the road's condition, the distance from which shots were fired, the weapons used, and the reason for the alleged Siahkar declaration. The court also noted the prosecution withheld another witness without explanation, which allowed the court to presume that witness's testimony would have hurt the prosecution's case. Additionally, the recovery of the alleged murder weapon was suspiciously delayed by nearly two years, undermining its credibility, and medical evidence did not match the witnesses' account.

The court reaffirmed that weapon recovery alone cannot prove guilt and that any genuine doubt in a criminal case must benefit the accused. Because the prosecution's evidence was inconsistent and unreliable, the appeal was allowed, the conviction was set aside, and the accused was acquitted, while the complainant's request for a harsher sentence was rejected.
