Abdul Razzaq V. The State,
YLR 2018 Note 280 · Balochistan High Court
This case involved Abdul Razzaq, who was convicted by an Anti-Terrorism Court in Sibi for possessing 550 grams of explosive material, receiving seven years imprisonment under the Explosive Substances Act and fourteen years under the Anti-Terrorism Act, to run concurrently. He appealed to the Balochistan High Court.
The prosecution claimed FC personnel caught Razzaq acting suspiciously near a highway and recovered explosives from him. However, when the High Court examined the evidence, it found serious problems. The four prosecution witnesses contradicted each other on basic facts, such as where and by whom the explosive was weighed. No detonator, wires, or remote control were found alongside the alleged explosive. Critically, the material was never sealed at the scene and was never sent to a proper Forensic Science Laboratory for testing. Instead, an analysis report was obtained from a Commander of Civil Defence, who had no proven qualifications to identify explosive substances. There were also unexplained gaps and inconsistencies in the investigating officer's handling of the case file.
The High Court ruled that convictions in explosives cases require that the recovered material be properly sealed at the spot and examined by a qualified forensic expert. Since neither happened here, and the evidence was contradictory, the court held these lapses created reasonable doubt. The appeal was allowed, and Razzaq's conviction and sentence were set aside, resulting in his acquittal. The case highlights the importance of proper forensic procedure and consistent
