Abdul Ghafoor Kalmati V. Naguman and 15 others,

YLR 2018 Note 268 · Balochistan High Court

This case from the Balochistan High Court involved a dispute over land in Pasni. A group of plaintiffs had filed a civil suit (Suit No. 4 of 2016) seeking correction of mutation entries related to land they claimed was gifted and inherited from a deceased owner, Sher Jan. That suit was settled through a compromise, and the trial court issued a decree based on it.

Meanwhile, the petitioner, Abdul Ghafoor Kalmati, had filed his own separate suit (Suit No. 15 of 2016) over the same land against overlapping parties. He challenged the compromise decree in the other suit before the Majlis-e-Shoora, Gwadar, which set aside that decree and ordered the two suits to be consolidated and heard together.

After consolidation, Kalmati asked the trial court to formally add him as a party to Suit No. 4 of 2016 as well. The trial court refused, and he challenged that refusal in this revision petition before the High Court.

The High Court upheld the trial court's decision, reasoning that since both suits already covered the same subject matter and had been consolidated, there was no real prejudice to Kalmati. He still had his own pending suit in which he could fully argue his claims. The court found no legal error in the trial court's order and dismissed the revision petition outright.

The case illustrates how courts handle overlapping lawsuits over the same property: consolidation can make separate applications to be added as a party unnecessary, since litigants retain their right to be heard through their own existing suit.
