YLR 2018 Note 20 · Balochistan High Court
This case dealt with a long-running dispute over marble mining leases in Chagai district, Balochistan, and how those leases should be divided among family members following a family partition and a related arbitration decree from 1979. The original leaseholders' successors argued that mining rights meant for them had, over the years, been improperly transferred or reassigned to other parties and companies (including firms called Pubni Minerals and Mir Marbles) without proper notice to them, sometimes even while related litigation was pending before the Supreme Court. Multiple petitioners filed constitutional petitions challenging various government orders, notifications, and allotment letters issued by the Balochistan Mines and Minerals Department, and one party also filed a contempt application. Because several connected cases raised overlapping facts and legal questions, the Balochistan High Court decided them together in a single judgment.
The court found that the dispute involved serious factual disagreements about who was entitled to which leases and shares, and that these disputed facts had not been properly examined by the mining authorities. It also found that the petitioners had not been given a fair opportunity to be heard before the disputed notifications and orders were issued. Rather than deciding the merits itself, the High Court set aside the impugned notifications and sent the matter back to the mining authorities, directing them to hear all the parties involved and decide the case afresh.
This judgment matters because it reinforces the basic legal principle that government authorities must provide affected parties a fair hearing before making decisions affecting their property or business rights, especially in cases involving complicated factual and family ownership disput
