Zulfiqar Ali Bakhtiari and others V. Mst Khalida Bakhtiari and anohter,

YLR 2018 942 · Balochistan High Court

This case involved a family dispute over inheritance. After Sajjad Ali Bakhtiari died in 1985, his children were entitled to shares in the movable and immovable property he left behind, including shops that were generating rental income. One daughter, Khalida Bakhtiari, filed a lawsuit claiming that her siblings (who were in possession of the properties) were denying her rightful Islamic inheritance share and had failed to distribute the estate, including years of accumulated rent from twelve shops.

The trial court heard evidence from both sides and ruled in favor of the daughter, granting her a declaration of her inheritance share. The family members who lost appealed to the District Judge, but that appeal was also dismissed. They then approached the Balochistan High Court through a revision petition, arguing that the lower courts had misread the evidence and wrongly favored the daughter's claims.

The High Court dismissed the revision petition. It explained that when two lower courts have already agreed on the facts of a case (called "concurrent findings"), the High Court's revisional powers are limited. It cannot re-examine the merits of the case as if it were an appeal; it can only step in if the lower courts' decisions were clearly illegal, based on misreading of evidence, or so unreasonable as to be shocking or perverse. Since neither court's reasoning suffered from these defects, the High Court upheld the original decision favoring the daughter's inheritance claim. This case illustrates the limited scope of High Court revision powers over factual findings already agreed upon by two courts.
