Ahmed Khan Floraid Company through owner V. Secretary Mines and Minerals Government of Balochistan and 2 others,

YLR 2018 718 · Balochistan High Court

This case involved a mining business, Ahmed Khan Floraid Company, which had applied for a No Objection Certificate (NOC) from the Balochistan government's Mines and Minerals department in order to seek a prospecting license for mining fluorite in an area in Loralai. The petitioner claimed the NOC had been issued to him but the authorities failed to take further action on it, while a rival party (respondent No. 3) was allegedly continuing illegal mining despite having his own allotment and work orders cancelled earlier due to fraud and tampered documents. Frustrated by the inaction, the petitioner approached the Balochistan High Court directly, asking it to declare him entitled to the NOC, expose the rival's fraud, and stop the illegal mining.

The High Court did not examine these claims on their merits. Instead, it held that the petition was not "maintainable," meaning it should not have been filed in this form at all. The court found that alternate remedies existed - the petitioner could have approached the Secretary of Mines and Minerals or other departmental authorities to resolve his grievance before rushing to court. Under Pakistani law, courts can only be approached directly through a constitutional petition when no other effective remedy is available. Since such remedies existed here, the petition was dismissed, though the petitioner was allowed to pursue his complaint through the proper administrative channels.

This case highlights an important principle: courts generally expect parties to exhaust available administrative remedies before seeking judicial intervention.
