Mukhtiar and anohter V. The State and anohter,
YLR 2018 2490 · Balochistan High Court
This case is about how far a trial court can go in allowing new witnesses to be called during a criminal trial. Two men, Mukhtiar and another, were accused in a murder case where the victim's death was initially reported as a road accident but later alleged to be murder by strangulation. During the trial, the prosecution's key eyewitnesses refused to testify, reportedly out of fear of the accused. The complainant then asked the trial court, under Section 540 of the Criminal Procedure Code, to summon additional witnesses to replace those who would not appear. The trial court granted this request. The accused challenged that decision before the Balochistan High Court, arguing that these additional witnesses had never been named in the police challan or in earlier statements recorded under Section 161 of the CPC, so introducing them now was really an attempt to patch up gaps in the prosecution's case rather than a genuine search for truth.
The High Court agreed with the accused. Relying on a Supreme Court precedent (Shahbaz Masih v. State), it held that witnesses whose names do not appear in the list of witnesses and whose statements were never recorded under Section 161 or 164 cannot simply be summoned later to strengthen a weak case. The court therefore set aside the trial court's order allowing these witnesses.
The case matters because it clarifies limits on courts' power to summon witnesses, protecting the fairness of criminal trials by preventing prosecutors from introducing new, unvetted witnesses late in proceedings simply because earlier witnesses failed to cooperate.
