Sajjid Ahmed and others V. National Accountability Bureau, through Director General and another,

YLR 2018 2479 · Balochistan High Court

This case concerns several public officials in Balochistan accused of corruption under the National Accountability Ordinance, 1999. The National Accountability Bureau (NAB) alleged that the petitioners had conspired to appoint seven fake ("bogus") teachers in Quetta and then unlawfully activated their salaries, causing a financial loss of over 43 lakh rupees to the government. Some petitioners were accused of making the fraudulent appointments, while others, including officials from the Accountant General's office, were accused of processing the salary payments improperly.

The petitioners sought pre-arrest bail, arguing that they were innocent, had cooperated fully during the inquiry, and that the case against them was weak. Some pointed out inconsistencies, such as one petitioner having retired years earlier or being abroad during the alleged offence, while another argued he did not even have the authority to approve salaries. Importantly, in earlier, similar cases arising from the same investigation, the High Court had already granted bail to other accused persons facing the same allegations.

The Balochistan High Court held that since it had already confirmed bail before arrest for other accused in connected cases based on identical allegations, fairness and consistency required that these petitioners be treated the same way. The court therefore confirmed pre-arrest bail for the petitioners, emphasizing the principle that similarly situated accused persons should receive similar treatment from the courts.
