YLR 2018 2053 · Balochistan High Court
This case involved four men convicted of murdering Attaullah, the brother of the complainant, following a property dispute between the two families. The prosecution alleged that on the night of the incident, the accused, armed with daggers, knives, and sticks, attacked the victim, who died from his injuries at the hospital. The trial court had found the appellants guilty and sentenced them to life imprisonment, along with compensation to be paid to the victim's family.
On appeal, the Balochistan High Court re-examined the evidence, particularly the testimony of the three eyewitnesses, including the complainant. The court found serious contradictions between their accounts, such as disagreement over what weapons different accused carried, confusion over how many vehicles were used to flee the scene, and even disagreement over the time the incident occurred. The court also noted it was suspicious that none of the eyewitnesses, despite being present and closely related to the victim, sustained any injuries themselves during an attack by eight armed men.
Given these inconsistencies, the court ruled that the prosecution had failed to prove its case beyond reasonable doubt. Applying the well-established legal principle that any genuine doubt in a criminal case must benefit the accused as a matter of right, not favor, the court overturned the convictions and acquitted all four appellants, setting aside their life sentences. This case highlights how inconsistent witness testimony can undermine even serious criminal prosecutions.
