Regional Election Commission, Naseerabad V. Abdul Ghafoor,

YLR 2018 1917 · Balochistan High Court

This case is about a criminal complaint alleging that a politician, Abdul Ghafoor, submitted a false educational qualification document when he contested a Provincial Assembly election in Balochistan. He had used a religious seminary certificate, claiming it was equivalent to a bachelor's degree, to meet the minimum education requirement for candidates at the time. His opponent challenged this before an Election Tribunal, which ruled him unqualified and cancelled his election victory. He appealed unsuccessfully to the High Court and Supreme Court, with the Supreme Court reportedly making serious observations that he had submitted a false affidavit. Following this, the Regional Election Commission filed a criminal complaint against him for filing a false declaration, but the trial court (Sessions Judge) acquitted him.

The Election Commission appealed this acquittal to the Balochistan High Court. The High Court found serious problems with the trial court's handling of the case: it had failed to summon relevant official records from the Election Commission, and had not given both sides a fair and full opportunity to present their evidence. The High Court described the trial court's judgment as poorly reasoned, unjustified, and not sustainable in law.

As a result, the High Court set aside the acquittal and sent the case back to the trial court to be decided afresh, this time with proper evidence-gathering and fair opportunity for both sides. This case highlights the importance of thorough judicial process in election-related fraud cases, especially those involving candidates' qualifications and truthful declarations.
