Abdul Haq alias Abdullah V. Muhammad Naseem Achakzai,

YLR 2018 1157 · Balochistan High Court

This case involved an appeal against the acquittal of a man accused of cheating under Section 420 of the Pakistan Penal Code. The complainant alleged that a vehicle was purchased and later sold through a chain of transactions involving several people, and that the vehicle turned out to belong to someone else, who reported it missing. The complainant claimed that the accused, along with others, conspired to have the vehicle released to them through court proceedings (superdari) while the last buyer was reimbursed by the appellant, leaving the complainant cheated.

The trial court had acquitted the accused, and the complainant appealed. The Balochistan High Court upheld the acquittal, dismissing the appeal. It found the case highly suspicious because the police complaint was filed nearly four years after the alleged cheating took place. The court held that the dispute appeared to be a civil matter over a vehicle transaction rather than a criminal offense, since there was no evidence of dishonest intention at the time the property changed hands, which is essential for a cheating charge to succeed.

The judgment reaffirms important legal principles: an accused enjoys a stronger presumption of innocence after acquittal, courts should be cautious about overturning acquittals unless there is a clear error, and any reasonable doubt must benefit the accused as a matter of right, not favor. This case is significant for reinforcing how criminal cheating charges are distinguished from ordinary civil disputes.
