Muhammad Hashim and another V. The State,
YLR 2017 983 · Balochistan High Court
This case is about two men, Muhammad Hashim and Sanaullah, who were convicted by a Special Judge in Lasbella and sentenced to life imprisonment for possessing 40 kilograms of charas (a narcotic), allegedly found in two bags beneath their seats on a passenger coach that was stopped for checking by Coast Guards.
The Balochistan High Court overturned their convictions and acquitted them, giving them the benefit of the doubt. Several serious problems undermined the prosecution's case. There was no documentary evidence, such as seat numbers or tags, actually linking the bags to the two accused men, so merely sitting near the bags was not enough to prove they knowingly possessed the drugs. The claim that the men admitted ownership of the bags seemed illogical, since no one carrying such a large quantity of contraband would openly claim it. No independent witness, such as a fellow passenger or the driver, was included in the recovery process despite others being available. A key prosecution witness could not even identify the accused in court, suggesting he wasn't really present during the recovery. Most strikingly, the forensic laboratory report showed the drug samples were sent for testing before the alleged recovery and case registration even happened, a glaring contradiction that destroyed the report's credibility.
The court reaffirmed the basic principle that an accused person is entitled to acquittal if even a single reasonable doubt exists, not necessarily many. This judgment highlights how sloppy investigation and contradictory paperwork can unravel a narcotics case, protecting
