Shadi Khan V. The State ,

YLR 2017 878 · Balochistan High Court

This case is a criminal appeal decided by the Balochistan High Court in a matter involving murder charges linked to terrorism laws.

The appellant, Shadi Khan, was convicted by an Anti-Terrorism Court in Quetta of murdering two people—his sister Yasmin and a man named Abdul Ghani Marri, whom he suspected was his sister's lover. A police patrol responding to noise at night found both bodies in the courtyard of Shadi Khan's house, with Khan standing nearby holding a pistol. He reportedly confessed on the spot, explaining he killed them because he found his sister in a compromising situation with the man. He was sentenced to life imprisonment.

On appeal, Khan's lawyers challenged the conviction, but the High Court upheld it. The court found the police witnesses' testimony consistent and credible, noting that police officers can be reliable witnesses even without independent civilian witnesses, especially since the crime occurred inside a house at 2 a.m. where outsiders were unlikely to see anything. The recovery of the weapon from Khan's possession, medical evidence matching the injuries described, and his judicial confession (even though recorded twelve days later and later retracted) all supported the prosecution's case. The court also accepted that Khan's stated motive—anger over his sister's relationship—was credible and proven.

This judgment matters because it reinforces legal principles about honor-related killings, the reliability of police testimony, and the validity of delayed or retracted confessions in Pakistani criminal law.
