This case is about a mix-up over identity in a court execution proceeding. Two related civil suits had been decided, and one decree-holder (Syed Israr Haider Rizvi) was owed Rs. 1,900,000 under a decree issued against a company and its Chief Executive Officer. When the decree-holder tried to enforce the decree, the executing court ended up ordering the salary of a man named Naveed Ahmed to be attached, believing he was the same person as the company's CEO, whose name appeared in the case as Naveed Aftab.
Naveed Ahmed objected, saying he was a government servant with no connection to the company, that he was not a party to the original suit, and that the actual CEO was his brother, Naeem Aftab. He argued he was being wrongly targeted, possibly due to a personal family dispute after he divorced the decree-holder's relative. The executing court rejected his objections and upheld the attachment.
The Balochistan High Court disagreed. It held that merely sharing a similar name is not enough to make someone liable under a decree—the person must also share the same interest, character, or legal capacity as the actual judgment debtor (such as being a partner, guarantor, surety, or legal heir). Since none of this was shown for Naveed Ahmed, the court set aside the executing court's order and sent the case back for proper determination of the judgment debtor's true identity. This case highlights the importance of correctly identifying who is legally bound by a court decree before enforcing it against them.
