Principal, Bolan Medical College, Quetta V. Dr. Sharbat Khan and 4 others,

YLR 2017 372 · Balochistan High Court

This case involved a housing dispute at Bolan Medical College, Quetta. Dr. Sharbat Khan sued to be declared the lawful allottee of a government bungalow and sought to stop the college from allotting it to anyone else or handing over possession. The trial court ruled in his favor, declaring him the rightful allottee and restraining further allotment. It also ordered the Principal of the college to personally pay Rs. 25,000 in compensatory costs under Section 35-A of the Civil Procedure Code, reasoning that she had issued an illegal and unauthorized order that forced the plaintiff into unnecessary litigation.

The Principal challenged only this cost order, not the main decision. Her appeal was dismissed on a technicality (filed late), so she approached the High Court.

The High Court examined Section 35-A, which allows compensatory costs only when a party's claim or defence is shown to be false or vexatious to their own knowledge, when the opposing party specifically objected to it at the earliest opportunity, and when the trial court records clear reasons for such a finding. The judge found none of these conditions were met here: the plaintiff never objected that the defence was false or vexatious, and the trial court gave no reasons for imposing costs.

Therefore, the High Court set aside only the portion of the judgment imposing compensatory costs, while leaving the rest of the ruling intact. The case clarifies that courts cannot casually impose such penalties without following the specific procedural safeguards built into the law.
