YLR 2017 275 · Balochistan High Court
This case involved a husband (petitioner) challenging a family court decision ordering him to pay his former wife dower, dowry articles, and maintenance allowance worth over Rs. 650,000. The wife had filed a suit after their marriage ended in divorce, and the trial court ruled in her favor based partly on receipts for dowry items that she produced during her own testimony.
The husband appealed, but the appellate court dismissed his appeal solely because it was filed three days late, without examining the actual merits of the case, including his objection that the receipts used as evidence were not properly admissible since his ex-wife was not the author of those receipts nor had she personally issued them.
The Balochistan High Court found that the appellate court should not have thrown out the case purely on a technical delay of a few days without considering whether the evidence was properly admitted and whether the delay could be excused given the circumstances. Relying on Supreme Court precedents, the High Court held that courts can take up delayed matters when the merits of the case warrant it.
As a result, the High Court set aside the appellate court's judgment and sent the case back for a fresh decision on the actual merits, including the question of whether the receipts were legally admissible evidence, giving both parties a chance to be heard again.
This case matters because it reinforces that procedural technicalities like minor delays should not override substantive justice, especially in family law disputes involving financial claims after divorce.
