Saadullah V. The State,
YLR 2017 2434 · Balochistan High Court
The case is about a man convicted of murdering his sister, Bibi Hafeeza, who was fatally shot outside the Sessions Court in Quetta in 2001 while police were escorting her to a hearing. The appellant was arrested at the scene with the weapon and confessed that he killed her because she had been "kidnapped" from Pishin, a case then pending in court. He was originally convicted of a lesser offence, but after appeals by both sides, the Supreme Court enhanced his sentence to life imprisonment and sent the case back to the trial court to resolve two specific questions: whether one Muhammad Fayyaz was the deceased's husband, and whether he could be treated as her legal heir for purposes of a compromise (compounding) under Section 345 of the Criminal Procedure Code, since Pakistani law allows murder cases to be settled if legal heirs agree.
The trial court found that Fayyaz was indeed her husband and legal heir, and since he had not agreed to any compromise, rejected the compromise deed and convicted the appellant under Section 302(b) for life imprisonment plus compensation.
On appeal, the Balochistan High Court examined whether the marriage between Fayyaz and the deceased was validly proven, given there was no written nikah nama. The court held that oral nikah is valid, especially in tribal and traditional society. It also held that testimony of police officials is credible unless the defense proves ill will, rejecting the argument that police witnesses were unreliable. This case matters because it clarifies the validity of oral marriages
