YLR 2017 179 · Balochistan High Court

This case involved a family property dispute. The respondents had filed a suit seeking declaration and possession through partition of inherited property from their predecessor, Mehrban. The trial court (Civil Judge) decided in their favor. When the petitioners (the losing side) tried to appeal, they filed before the District Judge in Quetta. However, the appellate court returned their appeal, saying it lacked jurisdiction because the property's value exceeded Rs. 500,000, which would mean the appeal should go to the High Court instead.

The petitioners challenged this, arguing that the suit had been valued at only Rs. 37.50 for jurisdiction and court-fee purposes in the original plaint, and that this figure—not any later estimate of the property's worth—should determine which court hears the appeal.

The Balochistan High Court agreed with the petitioners. It held that the forum for appeal must be based on the value stated in the original plaint, not on the property's market value as it may have grown during the case or come out through evidence later. Since neither the defendants had challenged this valuation during the trial, nor had the trial court formally revalued it through proper legal procedure, the original figure of Rs. 37.50 stood. The District Judge, not the High Court, was the correct appellate forum. The High Court set aside the order returning the appeal and directed the District Court to decide the case within two months, reaffirming that appeal rights should follow the plaint's stated value, protecting litigants from losing their proper forum due to later property valuation disputes.
