Niaz Ali V. The State ,
YLR 2017 1652 · Balochistan High Court
The case involved Niaz Ali, who was convicted of attempting to commit robbery under sections 392 and 511 of the Pakistan Penal Code. According to the prosecution, Niaz Ali and a co-accused, armed with pistols, tried to snatch a motorcycle from the complainant at gunpoint on a highway near Dera Murad Jamali. The complainant resisted, and Niaz Ali was caught on the spot while his companion escaped. A trial court convicted him and sentenced him to three years' rigorous imprisonment plus a fine, and an appellate court upheld this conviction, although his co-accused was acquitted on appeal due to benefit of the doubt.
Niaz Ali then filed a revision petition before the Balochistan High Court, arguing that the evidence had been wrongly appreciated and that it was unfair for him to remain convicted when his co-accused, tried on the same evidence, was acquitted.
The High Court examined the testimony of the complainant, an eyewitness, and police witnesses, finding their accounts consistent, credible, and unshaken by cross-examination, with no evidence of false implication due to enmity or grudge. The court therefore upheld the conviction, finding no reason to disturb the finding of guilt. However, it found the three-year sentence too harsh given the circumstances and reduced it to eighteen months.
This case illustrates how appellate courts can reassess evidence and adjust sentences without overturning a conviction, balancing accountability with proportionality in punishment.
