Muhammad Iqbal and another V. Deputy Commissioner District Lasbella and 4 others,
YLR 2016 2746 · Balochistan High Court
This case involved a father and daughter whose domicile certificates for Lasbella district had been cancelled by the Deputy Commissioner. Domicile certificates are official documents confirming a person's residence in a particular area, and they matter because they can affect rights like job quotas, admissions, and other benefits tied to residency.
The Deputy Commissioner cancelled the certificates after an inquiry suggested the petitioners did not actually live permanently in the area in question. However, the petitioners challenged this cancellation, arguing they were never given a proper chance to defend themselves before their certificates were revoked.
The Balochistan High Court agreed with the petitioners. It found that although an Assistant Commissioner had been asked to investigate the matter, there was no evidence that the petitioners were notified or allowed to participate in that inquiry. The Deputy Commissioner's own order only mentioned a personal visit to the area, without clarifying whether official land records were examined. The court held that since domicile certificates create legal rights for their holders, those rights cannot be taken away without following fair procedure.
Relying on established legal principles, including the rule that no one should be condemned unheard, the court ruled that the cancellation violated natural justice. It set aside the cancellation order and sent the case back for a fresh decision, this time requiring that the petitioners be given a genuine opportunity to present their case before any final ruling is made.
