Abdul Zahir V. Khuda-E-Dad and others,

YLR 2016 188 · Balochistan High Court

This case involved a property dispute over land that had been jointly owned. One party, Abdul Zahir, claimed he had purchased a share of the land from the predecessor of the other side and had it formally recorded through a mutation entry in the revenue records. The other side, Khuda-e-Dad and others, claimed this mutation was fraudulent and obtained through collusion with revenue officials, and they sued to have it cancelled, along with seeking possession of the land. The matter went through a trial court, which ruled in favour of Zahir, and then an appellate court, which reversed that decision in favour of the other side. Both parties then approached the Balochistan High Court through separate revision petitions.

The High Court ruled in favour of Abdul Zahir. It found that the opposing side's claim to cancel the mutation was filed too late, beyond the three-year limitation period, and that they failed to prove their allegations of fraud, especially since they had withdrawn those specific claims during the case and failed to produce key witnesses. The court held that revenue records carry a legal presumption of truth that can only be rebutted with solid evidence, not mere verbal claims. It also found that the appellate court had wrongly allowed a delayed appeal without good reason. As a result, the High Court restored the trial court's original decision favouring Zahir.

This judgment is significant because it reinforces the evidentiary weight given to official land records and clarifies limitation rules and standards for proving fraud in property disputes.

ہائی کورٹ نے عبدالظاہر کے حق میں فیصلہ دیا۔ عدالت نے قرار دیا کہ مخالف فریق کا انتقال کی منسوخی کا دعویٰ تین
