Muhammad Azhar Awan V. Government of Balochistan through Chief Secretary and 3 others,
YLR 2016 1842 · Balochistan High Court
This case involved a petitioner, Muhammad Azhar Awan, who asked the Balochistan High Court to direct the provincial government to compensate his family for losses of life and property, which he claimed resulted from acts of terrorism linked to private respondents and certain officials of a cooperative bank and local revenue offices. He said his family had lawfully purchased ownership and tenancy rights to land in Dasht, Mastung, decades earlier, and that this ownership had already been upheld through civil court proceedings, appeals, and a revision petition. Despite this, he alleged that rival claimants had forcibly occupied the land, destroyed property including a house, tube well, and trees, and pursued fraudulent complaints against him and his family, warranting government compensation as victims of terrorism.
The High Court found that the dispute was essentially a factual and title controversy that had already been litigated extensively in civil courts, with the petitioner's ownership upheld and attempts to overturn it having failed. Allegations of fraud remained unproven in any forum. The court held that such factual disputes could not be resolved through constitutional petitions under Article 199, which are not meant to substitute for ordinary civil remedies, especially where alternate remedies exist or have already been pursued. The petition was therefore found not maintainable.
This case is significant because it reinforces the principle that constitutional jurisdiction is not a suitable avenue for resolving disputed facts or claims requiring evidence, particularly when alternate legal remedies are available or already exhausted.
