Abdul Haleem V. The State,

YLR 2016 1418 · Balochistan High Court

This case involved a man convicted of murder and attempted murder over a family dispute involving his sisters and their allegedly abusive husbands. The trial court had found Abdul Haleem guilty of killing Ahmed Ali and injuring his brother, sentencing him to life imprisonment plus additional jail time and fines. He appealed the conviction, while the complainant separately sought a harsher sentence, including the death penalty.

The Balochistan High Court reviewed the evidence and found serious problems with the prosecution's case. The eyewitnesses claimed to have been present during a shooting but were not themselves hit by any bullets, which the court found suspicious. The police site plan failed to show where the witnesses or accused were standing during the incident, raising doubts about whether they were actually there. There were also unexplained delays in sending the weapon and bullet casings for forensic testing, which undermined the reliability of that evidence. Additionally, a key witness statement was recorded three days after the crime, further weakening its credibility. The accused also presented evidence supporting an alibi.

Given these gaps and inconsistencies, the court ruled that the prosecution had not proven its case beyond reasonable doubt. It set aside the conviction, acquitted Abdul Haleem, and ordered his release. This case highlights how Pakistani courts scrutinize forensic delays, witness credibility, and physical evidence like site plans to ensure convictions are based on solid, trustworthy evidence rather than assumptions.
