Inayatullah and 2 others V. Government of Balochistan through Senior M.B.R. and 3 others,

YLR 2016 1385 · Balochistan High Court

This case concerned land in Quetta originally allotted by the government to two individuals, Allah Bakhsh and Shehnaz Akhtar, who later sold it to the petitioners. After the sale, the government cancelled the original allotment, and the petitioners sued for a declaration that they were lawful owners and could not be dispossessed. The trial court initially ruled in their favor, but the appellate court reversed this and dismissed the suit. The matter eventually went to the Supreme Court, which sent it back to the Balochistan High Court to be decided on merits.

The High Court dismissed the petitioners' case. It held that under the Balochistan Land Lease Policy of 1988, a government allotment or lease does not automatically create ownership rights. A lessee only gains ownership after remaining in possession for 45 years, and until then cannot legally sell, sublet, or transfer the land. Since the original allottees never had ownership, they could not pass valid title to the petitioners through sale. The court applied the principle that a seller cannot transfer better rights than they themselves hold, meaning the petitioners could not claim to be genuine "bona fide purchasers" of land that was illegally transferred. The court also noted that land on highways cannot be allotted or leased at all.

This ruling matters because it clarifies that government land allotments come with strict conditions, and buyers who purchase such land before ownership fully vests in the original allottee acquire no legal title, regardless of paperwork or possession.
