YLR 2015 440 · Balochistan High Court

This case concerns a dispute over a rented property in Quetta. The landlords (appellants) sought to evict their tenant, Mira Jan, under the West Pakistan Urban Rent Restriction Ordinance, citing default in rent payment, illegal subletting, and their own genuine need for the premises. The tenant, however, denied any landlord-tenant relationship, claiming he had purchased the property and thus owed no rent or obedience to the landlords. The Rent Controller initially sided with the tenant and dismissed the eviction application, prompting the landlords to appeal to the Balochistan High Court.

The High Court examined the tenancy history, including an original 1990 tenancy agreement, later property transfers, and conflicting claims by the tenant and another party who also claimed ownership. The court found that the tenant could not provide solid evidence proving he owned or independently possessed the property. It also noted that an agreement relevant to the ownership claim was never specifically denied by the opposing party, which under law amounts to an admission of its execution. Based on this, the court concluded that a landlord-tenant relationship did exist.

The High Court set aside the Rent Controller’s judgment, accepted the eviction application, and ordered the tenant to vacate the premises within two months. This case highlights how courts assess competing claims of ownership versus tenancy, and reinforces the principle that an unchallenged document’s execution can be treated as admitted in landlord-tenant disputes.
