Syed Fateh Agha V. Accountability Court and 2 others,

YLR 2015 2235 · Balochistan High Court

This case is about a property dispute between a citizen, Syed Fateh Agha, and the National Accountability Bureau (NAB). Years earlier, the petitioner had been allotted and compensated for land by the Quetta Development Authority, built shops and flats on it, and obtained a completion certificate. NAB later took up a complaint about the pricing of the land allotment. The petitioner applied for a voluntary return, NAB accepted it, and he paid the entire agreed amount of about Rs. 2.18 million. NAB and QDA then issued No Objection Certificates, and the petitioner sold the property through a registered sale deed. Despite this settlement, NAB later issued a fresh order freezing the very same property, which was subsequently confirmed by the Accountability Court.

The petitioner challenged this freezing order in the High Court, arguing it amounted to punishing him twice for the same matter. The authorities argued he should have filed an appeal instead of a constitutional petition. The High Court found that the law did not actually provide any appeal against this type of freezing order, so the petitioner was right to come directly to the High Court. On the merits, the Court held that freezing property that had already been cleared through the voluntary return process violated the constitutional protection against double jeopardy. It declared NAB's freezing order and the Accountability Court's confirmation of it null and void, and ordered the property de-frozen. The case matters because it reinforces that once a matter is settled through legal process, authorities cannot reopen it against the same person over the same property.
