The State through Prosecutor General V. Muhammad Kaleem Bhatti,
YLR 2015 2214 · Balochistan High Court
This case was about a government cashier, Muhammad Kaleem Bhatti, who was accused of criminal breach of trust (misappropriation) under Section 409 of the Pakistan Penal Code. He had worked as cashier in the Deputy Commissioner's office in Quetta and, when transferred to another district, allegedly failed to hand over important official records such as cash books, registers, and budget files to the new cashier, despite being officially directed to do so.
At trial, the Special Judge (Anti-Corruption), Quetta, acquitted him. The State appealed this acquittal to the Balochistan High Court.
The High Court found a serious legal problem with how the trial court had reached its decision. The trial judge had relied heavily on documents submitted by the accused, even though the accused had not given a formal defense statement or called any witnesses. These documents were never properly authenticated, and the prosecution was never given a chance to cross-examine anyone about them, violating basic rules of evidence under the Qanun-e-Shahadat Order, 1984.
Because of this procedural flaw, the High Court held that the trial court's findings were improper and based on evidence that should not have been admitted. It partly allowed the appeal, set aside the acquittal, and sent the case back to the trial court, directing it to let the accused properly present any evidence in his defense following correct legal procedure, and to decide the case afresh within three months.
This case highlights the importance of following proper evidentiary procedures, especially regarding authentication of documents and the right to cross-examination, even when a court is
