YLR 2015 2106 · Balochistan High Court
This case is about a widow seeking a succession certificate after her husband, a government sweeper, was killed by terrorists in 2013. She wanted authority to collect his compensation, cash payment, and salary dues, totalling over Rs.50 lakh. No other heir objected to her claim. The trial court agreed she was the sole legal heir entitled to the certificate but insisted she provide two sureties equal to the certificate's value before it would be issued. When she asked to be excused from this requirement, the trial court rejected her request with a one-line order, giving no reasons at all.
The Balochistan High Court found this one-line dismissal unacceptable because a judicial order must show that the judge actually considered the arguments raised, not just announce a conclusion. The court also clarified the law: under the Succession Act, courts must demand sureties only in specific situations involving summary proceedings; in other cases, requiring a surety is discretionary. Since all heirs agreed, there was no dispute over entitlement, and the purpose of a surety (protecting other possible claimants) did not apply here, the High Court ruled sureties were unnecessary.
The High Court set aside the trial court's order and directed that the succession certificate be issued to the widow, subject only to a personal surety bond from a government official, not the heavier requirement originally imposed. This case highlights that courts must give reasoned orders and shouldn't impose unnecessary burdens on undisputed heirs, especially vulnerable claimants like a widow.
