YLR 2015 1621 · Balochistan High Court
This case involved a dispute over water rights from a water channel called Wangoee Dhora, which flowed through land in Lasbela district. The original plaintiff, Wadera Lakho (father of the petitioners), claimed he had long irrigated his land from this water source and that the respondents had wrongfully blocked and diverted the flow onto their own land. He sued for a declaration of his rights and a permanent injunction.
The respondents argued that this very dispute had already been resolved through arbitration, with an award approved by the Assistant Commissioner, Hub Division, making the lawsuit legally barred. The trial court initially ruled in favor of the plaintiff, but on appeal, the Majlis-e-Shoora overturned that decision and dismissed the suit. The petitioners then challenged this reversal before the Balochistan High Court.
The High Court upheld the appellate court's decision. It found that an arbitration award already existed covering the same dispute, and under Section 32 of the Arbitration Act, 1940, no separate civil suit can be filed to decide the existence or validity of such an award. Instead, a party disputing an award must specifically challenge or seek to set it aside through the proper legal process, not file an ordinary suit. The court also noted that the petitioners' witnesses failed to provide solid evidence supporting their water rights claim.
This ruling reinforces an important legal principle: once an arbitration award exists, parties cannot bypass it by filing fresh lawsuits—they must use specific remedies under the Arbitration Act to challenge
