Zulikha Bibi V. Election Commission of Pakistan through Secretary and another,

YLR 2015 1584 · Balochistan High Court

This case from the Balochistan High Court dealt with a challenge to the eligibility of a candidate who had won a local government election. The petitioner, also a candidate in the same local body elections, argued that the winning candidate (respondent No.2) should not have been allowed to contest because he was simultaneously a government contractor and the Chairman of the District Zakat Committee, Lasbela. She claimed this violated eligibility rules under the Balochistan Local Government Act, 2010, which bars certain government-linked persons from contesting local elections.

The respondent argued that he had resigned from the Zakat Committee post before filing his nomination papers and that he received only an honorarium, not a salary, so he should not be treated as a government servant. He also argued the petition was filed too late and that the petitioner had no standing to challenge his election.

The court rejected these defenses. It held that the Chairman of a District Zakat Committee, being nominated by the government, qualifies as a public servant and is therefore disqualified from contesting local body elections. It also ruled that delay (laches) does not bar this type of petition—called a "quo warranto" petition, which questions someone's authority to hold public office—because such challenges involve a continuing legal issue. The court accepted the petition, set aside the respondent's election notification, and directed the Election Commission to remove his name from the list of validly elected candidates. The case clarifies eligibility rules for public officeholders contesting local elections.
