Noor Agha alias Abdullah V. The State,

YLR 2014 699 · Balochistan High Court

This case comes from the Balochistan High Court, deciding a jail appeal filed by a man named Noor Agha alias Abdullah, who had been convicted of murdering two brothers, Muhammad Nabi and Abdul Mateen, in Quetta in 2009. The trial court had sentenced him to death on two counts under Section 302(b) of the Pakistan Penal Code (murder), along with compensation to the victims' families, and the case was also sent to the High Court for confirmation of the death sentence.

The defense argued there were contradictions in witness statements, that medical certificates and inquest reports for the victims were missing, that there was a suspicious gap between arrest and the recorded confession, and that the alleged motive wasn't proven.

The High Court rejected all these arguments. It found that the accused's confession was voluntary, lawful, and credible, and that it matched eyewitness accounts from the father and brother of the victims, as well as an independent shopkeeper who witnessed the shooting. The court held that the missing medical certificates did not undermine the case, since the eyewitness testimony and confession were strong enough on their own. Finding the evidence reliable and the trial court's reasoning sound, the High Court dismissed the appeal and upheld the conviction and death sentence.

This case matters because it illustrates how Pakistani courts assess the reliability of confessions and eyewitness testimony in murder cases, and what evidentiary gaps (like missing medical reports) do or do not affect a conviction.
