YLR 2014 385 · Balochistan High Court
This case from the Balochistan High Court involved a family property dispute. A daughter (the appellant) sued her stepmother and others, claiming that a house registered in her stepmother's name was actually purchased by her late father and only put in the stepmother's name as a "benamidar" (a nominal or front owner) out of love and affection because the stepmother was childless. The daughter wanted the property declared as her father's actual asset, so that she and her stepmother could inherit shares in it according to Islamic inheritance law, and she also sought cancellation of a later mutation transferring the house to a third party.
The trial court dismissed her suit, and she appealed. The High Court upheld the dismissal. It found that the daughter failed to prove the essential elements of a benami transaction - particularly that her father actually paid for the house. Her witnesses did not personally witness any such payment, and she herself admitted she wasn't present during the purchase. The court also noted that her father never claimed during his lifetime that his wife was merely holding the property on his behalf, and he did not object when the stepmother later transferred the house to someone else.
The case matters because it illustrates how Pakistani courts handle benami property claims: the burden of proof lies heavily on the person alleging a sham ownership, and vague oral claims cannot override documented transactions and years of inaction.
