YLR 2014 293 · Balochistan High Court
This case is about a family property dispute in Quetta involving inheritance rights. After Jamal-ud-Din Kakar died, his children and widow were entitled to shares in his property. Two of his daughters filed a lawsuit seeking their rightful inheritance shares, along with partition, possession, and correction of property records. The defendants, who were other family members, admitted the relationship and that the property belonged to their late father, but claimed the daughters had already gifted away their shares to them. However, they had no written document proving this gift and relied only on oral testimony.
The trial court and the appellate court both ruled in favor of the daughters, rejecting the claim of an earlier gift. The Balochistan High Court upheld these decisions, dismissing the family members' revision petition. The court noted that during the case, one daughter did gift her share through a proper written compromise deed—which contradicted the defendants' claim that an earlier informal gift already existed. The court also held that new construction built by the defendants on the disputed property did not create any additional rights for them, since it was built at their own risk without the other heir's permission.
This judgment matters because it reinforces that Islamic inheritance shares pass automatically to heirs upon death and cannot be taken away through vague or unproven claims, especially affecting women's inheritance rights. It emphasizes that such rights require solid, credible evidence to override, not just oral assertions.
