Habibullah and another V. The State,

YLR 2014 1833 · Balochistan High Court

This case is about an appeal against a murder conviction. Two men, Habibullah and another appellant, were convicted of murdering Fida Hussain and sentenced to life imprisonment by a trial court in Quetta. They challenged this conviction before the Balochistan High Court.

The prosecution's case relied mainly on two eyewitnesses, who were nephews of the deceased. The High Court found serious problems with their testimony: these witnesses lived more than 100 kilometers from where the murder happened, and their explanation for why they were present at the scene was unconvincing. The person who first reported the crime to police was not even an eyewitness himself but had only heard about the murder secondhand. Additionally, other important witnesses, including an independent eyewitness and an injured victim of the same attack, were never brought to testify, which the court said allowed it to assume their testimony would have hurt the prosecution's case. The accused also presented documentary evidence supporting their claim that they were elsewhere when the crime occurred, and the prosecution failed to disprove this alibi.

Given these weaknesses, the High Court ruled that the prosecution had not proven its case beyond reasonable doubt. It overturned the trial court's judgment, acquitted both appellants, and ordered their release.

This case illustrates an important principle in criminal law: even a single reasonable doubt can be enough to acquit an accused person, and courts must carefully scrutinize witness credibility and the prosecution's failure to produce key evidence before upholding a conviction.
