Amir Muhammad V. Abdul Bari and 6 others,
YLR 2014 167 · Balochistan High Court
This case involved a property dispute in Quetta. Amir Muhammad had filed a civil suit seeking a declaration and cancellation of an inheritance mutation over shamilat (shared/communal) land, along with a permanent injunction. The trial court dismissed his suit in 2011 after hearing evidence from both sides. He then appealed, and while the appeal was pending, he asked the appellate court's permission to introduce two additional pieces of evidence that had not been presented at trial: an old revenue record (jama bandi) from 1950-51 and a pedigree table showing the family lineage connected to the land. The appellate court refused this request, so Amir Muhammad challenged that refusal before the Balochistan High Court.
The High Court upheld the appellate court's decision and dismissed the revision petition. It explained that Order XLI Rule 27 of the Civil Procedure Code allows additional evidence at the appeal stage only in limited situations: when the trial court wrongly refused to admit evidence that should have been admitted, when the appellate court itself needs the evidence to decide the case, or for some other substantial reason. Here, one document had already been part of the trial record, and the other was never mentioned in the original plaint or relied upon earlier, with no real explanation for the delay. The court stressed that such provisions exist to serve the court's own need for clarity, not to help a losing party patch up a weak case. This ruling reinforces strict limits on introducing new evidence late in litigation.
