Ghulam Mustafa V. The State,
YLR 2014 1550 · Balochistan High Court
This case involved an appeal by Ghulam Mustafa, who was convicted for trafficking narcotics under Pakistan's Control of Narcotic Substances Act, 1997. He had been sentenced by a Special Judge in Quetta to life imprisonment and a fine after being caught driving a truck carrying an enormous quantity of hidden drugs, 1,900 packets of charas and 400 kilograms of opium, concealed in specially built cavities in the truck's fuel tank. Anti-Narcotics Force (ANF) officials had stopped the truck based on prior intelligence, and after the driver and conductor tried to flee, the driver (the appellant) allegedly pointed out the hidden drugs.
On appeal, Mustafa's lawyer challenged the conviction, but the Balochistan High Court upheld it. The court found the prosecution's witnesses credible and consistent, noting that their accounts corroborated each other in detail and survived cross-examination without being discredited. A forensic lab report confirmed the recovered substances were indeed charas and opium. The court also rejected the argument that Mustafa should be acquitted just because a co-accused was acquitted on the same evidence, stating that courts must carefully separate reliable evidence from unreliable evidence rather than treating all accused persons the same way.
