Shahmeer V. The State,
YLR 2014 1138 · Balochistan High Court
This case was an appeal before the Balochistan High Court by a man named Shahmeer, who had been convicted by an Anti-Terrorism Court in Sibi for the murder (qatl-e-amd) of a man named Abdul Razzak. He was sentenced to life imprisonment and ordered to pay compensation (diyat) to the victim's family.
The conviction largely rested on a "disclosure statement" the accused allegedly made to police, supposedly leading to recovery of the dead body, plus testimony from witnesses who were later declared hostile by the prosecution.
The High Court found serious problems with this evidence. It noted that police already knew about the murder and had already found the body before the accused supposedly made his disclosure—meaning nothing new was actually discovered because of his statement. Under the law of evidence (Qanun-e-Shahadat Order), a mere statement to police like this is not admissible in court, since confessions to police officers are legally excluded to prevent misuse. The Court also found that the complainant's testimony was based on hearsay, and that the other witnesses had not actually implicated the accused in their direct testimony, only after being confronted with earlier police statements, which also cannot be used to secure a conviction.
Concluding that the prosecution failed to prove guilt beyond reasonable doubt using only inadmissible or unreliable evidence, the High Court set aside the conviction and sentence and acquitted Shahmeer, ordering his release. The case highlights important safeguards against convictions based on improper evidence.
