The Bank of Punjab through Regional Chief, General Manager, Quetta V. Khan Muhammad and 5 others,
YLR 2014 1002 · Balochistan High Court
This case involved a dispute between the Bank of Punjab, which rented commercial premises in Quetta, and the property owners, over whether increased rent applied after the original lease expired.
The bank had leased the premises for nine years starting in 2000, with rent set to increase by 15% every three years under the rental agreement. When the nine-year term ended in July 2009, the bank did not vacate the property. Legal proceedings followed, and the parties eventually reached a court-approved consent arrangement extending the bank's occupation until September 2010, on condition it kept paying rent regularly.
The owners argued that since the lease was extended by mutual consent, the original agreement's terms, including the 15% rent increase, still applied to the extended period. The bank argued the original lease had expired and the extension was essentially a new arrangement without any agreed rent increase.
Lower courts (the trial court and the appellate court) both ruled in favor of the property owners, ordering the bank to pay the increased rent. The Balochistan High Court upheld these decisions, reasoning that the original agreement itself allowed for extension of the lease term, and since the extension was granted by mutual consent, the original terms - including the rent escalation clause - continued to govern the tenancy.
This case matters because it clarifies that when a lease is extended with mutual agreement rather than simply overstayed unilaterally, the original contractual terms, including rent increases, remain binding unless the parties agree otherwise.
