Muhammad Amin v. State,

YLR 2013 703 · Balochistan High Court

This case involves three men, Muhammad Amin, Naik Muhammad, and Hazar Khan, who were accused of abducting a woman named Bibi Aliza from her brother's house at gunpoint, along with other serious charges including rioting and unlawful assembly. According to the First Information Report, the woman was already married to another man when she was allegedly forcibly taken away by the accused.

The accused sought bail after a trial court had rejected their application, reasoning that the woman was still in their custody, her marriage to one of the accused was disputed, she had not been recovered, and the alleged offences fell under a category of crimes where bail is normally restricted.

However, the Balochistan High Court found that the woman herself had appeared before a Judicial Magistrate and given a sworn statement saying she left her home voluntarily and married one of the accused by her own free choice. She specifically denied being abducted or forced, and denied any other marriage. The Magistrate had already allowed her to leave with her husband after recording this statement.

Based on this, the High Court concluded that no case of abduction was actually made out against the accused, despite the serious allegations in the original complaint. The court granted bail to all three applicants, requiring them to post surety bonds. This case illustrates how a woman's own sworn testimony affirming her consent and free will can undermine abduction charges brought by family members, even when the initial allegations were serious and specific.
