Safi Ullah v. State,
YLR 2013 643 · Balochistan High Court
This case is about a bail application filed by 14 men accused in a violent clash between two rival groups over possession of a property (a bungalow) in Quetta. According to the police, cross-firing broke out between the groups, killing two people and injuring several others, including bystanders. The accused were arrested at or near the scene, and weapons and ammunition were recovered from some of them. They were charged with murder, attempted murder, rioting with deadly weapons, unlawful assembly, and offences under the Anti-Terrorism Act.
The accused argued they were falsely implicated, that the allegations against them were vague and general, that it wasn't yet clear which side started the violence, and that they should get bail since further investigation was needed to establish guilt.
The Balochistan High Court rejected the bail application. The judge held that when people are accused of murder as part of an unlawful assembly, the key legal question is whether they were members of that assembly and whether the offence was committed in furtherance of the assembly's common purpose. If a member knew that violence could occur in pursuit of that shared purpose, all members can be held responsible for what happened. Since witness statements, weapon recoveries, and medical reports supported the prosecution's version, the case fell under a category where bail is normally denied. The court therefore refused bail to all the accused.
