Ajab Khan V. The State,

YLR 2013 618 · Balochistan High Court

This case involves Ajab Khan, who was convicted by a trial court for causing death and injuries through rash and negligent driving, an offense classified under Pakistan's Penal Code as qatl-e-khata (unintentional killing). He was sentenced to 10 years imprisonment along with orders to pay diyat (compensation for death) of Rs. 500,000 per victim and daman (compensation for injury) of Rs. 20,000 per injured person. The trial court had also ordered that he remain imprisoned until the diyat and daman amounts were paid.

Khan appealed and asked the Balochistan High Court to suspend his sentence and release him on bail while the appeal was pending, arguing that his offense was legally bailable and that he had already been out on bail during the original trial.

The High Court agreed to suspend the sentence and grant bail. It reasoned that since the offense was both bailable and compoundable (meaning the parties could reach a settlement), keeping Khan in jail would actually prevent him from earning money to pay the compensation he owed. The court felt that releasing him would give him a realistic chance to arrange the funds and could also open the door to a compromise between the families involved, promoting reconciliation.

This case matters because it illustrates how courts balance punishment with practical considerations, particularly in cases involving financial compensation to victims, favoring outcomes that could lead to compensation being paid and relationships being restored rather than pure incarceration.
