Moula Bakhsh and another V. The State,
YLR 2013 2407 · Balochistan High Court
This case involved two men, Muhammad Ibrahim and Moula Bakhsh, who were caught driving a tanker truck that customs officials intercepted. Hidden compartments in the vehicle were found to contain hashish. Ibrahim was the driver, while Bakhsh was a passenger sitting beside him. Both were convicted by a trial court under the Control of Narcotic Substances Act and sentenced.
On appeal, a two-judge bench disagreed about Bakhsh's guilt, so the matter went to a third judge to break the tie. That judge examined whether the prosecution had proven that both men knowingly possessed the drugs, since narcotics law places a heavy burden on the accused to prove innocence, but does not eliminate the prosecution's basic duty to prove the case beyond reasonable doubt.
The judge reasoned that because Ibrahim was driving the truck, he necessarily had control over it and could not credibly claim ignorance of drugs hidden inside. However, there was no similar evidence linking Bakhsh to the truck, its ownership, or the hidden compartments. The prosecution failed to show he was involved in transporting the drugs or connected to the vehicle in any meaningful way.
As a result, the court upheld the driver's conviction and sentence but acquitted the passenger, Moula Bakhsh. This case highlights that mere presence near contraband is not enough for conviction; the prosecution must establish a genuine link between each accused person and the crime, especially given the severe punishments narcotics offenses car
