Syed Shahbuddin V. Haji Abdul Ghani and 5 others,

YLR 2013 1955 · Balochistan High Court

This case is about a property dispute over the right of pre-emption, which under Islamic law allows certain people, such as co-sharers, those sharing rights like a pathway, or adjoining property owners, to claim priority to buy property that has been sold to someone else, provided they follow specific legal steps and timing requirements.

The appellant, Syed Shahabuddin, claimed he had this right as an adjoining property owner and said he had properly announced his intention to exercise it. His pre-emption suit was dismissed by the trial court, and he appealed to the Balochistan High Court.

The High Court examined whether the appellant had actually proven he qualified as an adjoining owner or in any of the other recognized categories entitled to claim pre-emption. It found that while the appellant claimed this status in his written complaint, his own testimony in court, describing the property boundaries, did not establish that he actually met the legal definition of a qualifying claimant. His witness's testimony was also found unreliable, since the witness admitted the property had already changed hands more than once before the transaction being challenged.

Because the appellant failed to establish his basic legal standing to claim pre-emption, the court held that other procedural requirements about how and when he announced his claim became irrelevant. The High Court found no error in the trial court's reasoning and dismissed the appeal, upholding the original decision against the appellant. This case illustrates how strictly courts require claimants to prove their qualifying status before pre-emption rights can even be considered.
