Mst. Alam Jan & others. v. Bibi Zainab & Others.,
YLR 2013 1509 · Balochistan High Court
This case involved a family property dispute in Pishin, Balochistan, over land left behind by a man named Baz Muhammad, who died without children. The core question was whether a man named Alam Khan (later called Muhammad Alam), who lived with the family and was eventually recorded as Baz Muhammad's son in official employment and irrigation records, was actually his biological son and legal heir, or an outsider with no right to inherit the property.
The plaintiffs, relatives of the extended family, argued that Alam Khan was not really Baz Muhammad's son but had falsely gotten his name recorded as such, and later used a religious ruling (Fatwa) to transfer the property into his name and then into his heirs' names. They asked the court to cancel these property transfers. The defendants, representing Alam Khan's heirs, argued he genuinely was Baz Muhammad's son and had lived his whole life acknowledged as such by the community and family.
The trial court dismissed the plaintiffs' suit, and the High Court upheld that decision on appeal. The judges found strong evidence—including Alam Khan's local certificate, identity card, and employment records—showing he was consistently recognized throughout his life as Baz Muhammad's legitimate son, both by Baz Muhammad himself and by others in the community. Since there was no error in how the trial court read the evidence, the appeal was dismissed.
This case matters because it shows how Pakistani courts weigh long-standing social acknowledgment and official documentation as strong proof of parentage and inheritance rights, especially
