Hamid Ali v. Mst. Farzana,
YLR 2013 1469 · Balochistan High Court
This case from the Balochistan High Court involved two related petitions between a husband, Hamid Ali, and his wife, Mst. Farzana, arising from a troubled marriage.
In the first case, the wife had filed a maintenance suit at the Family Court in Turbat, seeking monthly maintenance and medical expenses for their son. The husband argued the suit was not maintainable because an earlier maintenance dispute between the same parties had already been settled through a compromise, and also that the Turbat court lacked jurisdiction since he lived in Panjgoor. Both the trial court and the appellate court had ruled in the wife's favor.
In the second case, the husband had filed a suit in Panjgoor seeking restitution of conjugal rights and custody of their son, Talha, claiming the wife was being influenced by another respondent to avoid living with him. Both lower courts dismissed his suit.
The High Court found that since both parties actually resided in Panjgoor, the maintenance case should properly have been heard by the Family Court there, not in Turbat. It sent both cases back to the Panjgoor Family Court for fresh decisions. The court also clarified that principles of res judicata (Section 11, CPC) apply to family court proceedings, and emphasized that since the couple remained legally married, courts should make every effort to encourage reconciliation between spouses.
This case matters because it clarifies rules on territorial jurisdiction in family disputes and reinforces courts' duty to promote reconciliation in matrimonial matters.
