Muhammad Asif V. The State,
YLR 2012 832 · Balochistan High Court
This case is about a murder appeal from Balochistan. Muhammad Asif was convicted by an Anti-Terrorism Court in Khuzdar and sentenced to death for killing Munawar Shahwani by shooting him in the forehead with a pistol, during a gathering at a university hostel lawn. The complainant, a friend who witnessed the shooting, promptly reported the incident, naming only the accused. The accused fled but was later arrested by police in Mastung along with the vehicle he had used to escape.
On appeal, the Balochistan High Court examined the evidence and upheld the conviction and death sentence. The court found the eyewitness accounts credible, detailed, and consistent, noting that friendship between the witnesses and the victim did not undermine their credibility since there was no evidence of any motive to falsely implicate the accused. The daylight setting and familiarity between the parties ruled out mistaken identity. The eyewitness testimony was also supported by medical evidence confirming the fatal gunshot wound.
Importantly, the court clarified that the absence of a recovered murder weapon or unclear motive does not automatically weaken a prosecution's case if there is strong direct evidence, such as credible eyewitness testimony. This judgment reinforces the principle that Pakistani courts prioritize consistent, corroborated eyewitness accounts over technical gaps like weapon recovery when deciding serious criminal cases like murder.
