Abdul Lateef V. The State,
YLR 2012 794 · Balochistan High Court
Abdul Lateef was convicted by a Special Judge in Balochistan under the Control of Narcotic Substances Act, 1997, for possessing 40 kilograms of heroin, and was sentenced to life imprisonment along with a fine. Police, acting on secret information, raided his house and recovered the heroin from beneath the bedding of a cot he was sitting on. He appealed his conviction to the Balochistan High Court.
His lawyer argued that the investigation was invalid because it was carried out by Criminal Investigation Agency (CIA) staff, who are not legally authorized to investigate such cases, and that other procedural requirements were not followed, including that only a small sample of the heroin (40 grams) was sent for chemical testing rather than the whole quantity.
The High Court rejected these arguments. It held that while CIA personnel technically lack power to investigate cognizable offences, this was only a procedural irregularity since the case had properly been registered at a police station and the police station's own officer had filed the formal charges. Since no actual prejudice or injustice resulted, and the accused hadn't objected during trial, this did not invalidate the proceedings. The court also confirmed that sending only a sample for chemical analysis is legally sufficient, and found the defence's claims implausible. The appeal was dismissed and the conviction upheld.
This case matters because it clarifies that minor procedural lapses in narcotics investigations do not automatically void a conviction if no real harm was caused to the accused.
