Fida Hussain V. The State,
YLR 2012 781 · Balochistan High Court
This case involves Fida Hussain, who was convicted by a Sessions Judge in Kalat, Balochistan, for possessing an unlicensed Kalashnikov rifle under the Pakistan Arms Ordinance, 1965, and sentenced to three years in prison plus a fine. He appealed to the Balochistan High Court.
The background was that Hussain had originally been arrested during an alleged encounter with a Levies (police) party while they were investigating a separate robbery case. He was acquitted in those original cases. The arms case was essentially a spinoff of that earlier incident.
The High Court found several serious problems with how the case was handled. The same person, a Naib Tehsildar named Ghulam Haider, acted as both the complainant and the investigating officer, even though he was allegedly involved in the encounter itself. The trial court had already disbelieved his testimony in the related cases. Additionally, despite the arrest happening in a populated area with many bystanders present, no independent witnesses from the public were included in the recovery process, violating a legal requirement meant to ensure fair investigations. There was also no forensic report confirming the weapon was operational.
Given these serious procedural failures and the lack of credible, independent evidence, the High Court set aside the conviction and sentence, acquitting Hussain. The judgment underscores that police or officials involved in disputed encounters should not investigate their own actions, and that recoveries must be properly witnessed to ensure fairness.
