Mehboob V. The State,
YLR 2012 770 · Balochistan High Court
This case involved a man named Mehboob who was convicted by an Anti-Terrorism Court in Dera Allah Yar for allegedly abducting a young man named Inayatullah, along with two other accused. He was sentenced to life imprisonment and heavy fines under the Pakistan Penal Code's abduction provisions and the Anti-Terrorism Act. Mehboob appealed to the Balochistan High Court.
On reviewing the evidence, the High Court found the prosecution's case seriously lacking. The abductee himself, the most important witness, did not say anything implicating Mehboob and could not even identify him in court. The conviction rested mainly on the abductee's father, who had not witnessed anything directly but merely repeated what his son had told him about Mehboob's alleged involvement. There was no evidence that the house where the victim was recovered actually belonged to Mehboob, nor was the abductee found in his physical custody. The trial court appeared to have convicted him largely because his name matched one of the culprits' names, which the High Court said was not a valid basis for conviction. Additionally, the prosecution failed to properly prove that Mehboob had been absconding, since required legal procedures like newspaper proclamations were not followed, and he was never even questioned about this during his trial.
Because the evidence fell far short of proving guilt beyond reasonable doubt, the High Court set aside the conviction and sentence, acquitting Mehboob. This case highlights the importance of concrete evidence and proper procedure in criminal convictions, especially in ser
