YLR 2012 750 · Balochistan High Court

This case involved a CNG (compressed natural gas) filling station owner in Sibi, Balochistan, who had obtained a provisional license from the Oil and Gas Regulatory Authority (OGRA) to set up his station. He completed all the required steps: getting NOCs from the municipal administration, the Chief Inspector of Explosives, and Sui Southern Gas Company, and he spent over forty million rupees building the station and paying gas company dues. Despite completing everything, OGRA refused to issue the final marketing license, citing a moratorium the Prime Minister had imposed on new gas connections nationwide due to a demand-supply gap.

The petitioner challenged this refusal in the Balochistan High Court, arguing the moratorium only applied to new industrial connections and that he had secured permission before the ban was even imposed, so it shouldn't apply to him.

The court agreed with the petitioner. It found that he had already earned a vested right to the marketing license because he had completed all requirements before the moratorium existed. It also noted that OGRA never proved Balochistan's gas production exceeded its own needs, and under Article 158 of the Constitution, provinces producing natural gas get priority in meeting their own requirements. The court held that refusing the license violated the petitioner's fundamental right to conduct lawful business, and that courts can intervene when authorities act unfairly or unjustly. The petition was accepted, and OGRA was ordered to immediately issue the license, with the petitioner also awarded costs.
